1. Acceptance of Terms

By accessing or using the WisperWays website, mobile app, or any related services (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Services.

2. Description of Services

WisperWays provides an online travel planning platform that includes:

• AI-powered trip planner
• Curated travel packages
• Destination guides and recommendations
• Price match guarantee
• Newsletter subscription
• User accounts and saved trips

We are not a travel agent or tour operator unless explicitly stated. We facilitate planning and provide information, but the actual travel services (flights, hotels, activities) are provided by third-party partners.

3. User Accounts and Responsibilities

You may be required to create an account to access certain features. You agree to:

• Provide accurate and complete information.
• Keep your login credentials confidential.
• Notify us immediately of any unauthorized use of your account.
• Be at least 18 years old.

4. Bookings and Payments

When you make a booking through WisperWays, you agree to the terms of the third-party travel provider. All payments are processed by secure third-party payment gateways. We do not store your full payment card details on our servers.

Prices are subject to change until payment is confirmed. In case of any price discrepancy, we will notify you before processing the booking.

5. Price Match Guarantee

Our Price Match Guarantee applies to exact match packages (same destination, dates, inclusions, and room category). To claim:

• Submit the competitor URL and price.
• We verify within 4 business hours.
• If approved, we match the price and provide an additional 5% discount code.
• Discount code is valid for 48 hours and is non-transferable.

We reserve the right to reject any claim that does not meet our eligibility criteria.

6. Cancellations and Refunds

Our standard cancellation policy is as follows:

• Free cancellation up to 72 hours before departure.
• Cancellations made between 72 and 48 hours before departure will incur a 50% cancellation fee.
• Cancellations made less than 48 hours before departure are non-refundable.
• No-shows will be charged the full booking amount.

Please note that certain packages, flights, or peak-season bookings may have stricter cancellation policies as stated in the booking confirmation. Refunds, if applicable, will be processed within 5–10 business days to the original payment method.

7. Intellectual Property

All content on WisperWays, including text, graphics, logos, images, software, and AI-generated itineraries, is owned by or licensed to us. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

8. User-Generated Content

If you submit reviews, comments, or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content. You are solely responsible for the content you post.

9. Prohibited Activities

You agree not to:

• Use the Services for any illegal purpose.
• Attempt to gain unauthorized access to our systems.
• Scrape or extract data without permission.
• Interfere with the proper working of the Services.
• Upload malicious code or content.

10. Disclaimers and Limitation of Liability

WisperWays is provided on an "as is" and "as available" basis. We make no warranties of any kind, express or implied. We do not guarantee that the information provided is always accurate or complete.

To the maximum extent permitted by law, WisperWays shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Services.

11. Indemnification

You agree to indemnify and hold WisperWays harmless from any claims, damages, or expenses (including legal fees) arising out of your violation of these Terms or misuse of the Services.

12. Third-Party Links

Our Services may contain links to third-party websites. We are not responsible for the content or practices of those sites. Your interactions with third parties are solely between you and them.

13. Modifications to Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms on this page. Your continued use of the Services after changes constitutes acceptance of the new Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat.
